CE marking of the vessel
A vessel or its outboard engine is registered in Latvia if it has undergone a conformity assessment procedure and the vessel (outboard engine) is CE marked in accordance with regulatory enactments on the construction, conformity assessment and placing on the market of recreational vessel *. This requirement does not apply to:
- vessels and their engines previously registered in a Member State of the European Union;
- rowing boats of less than 2.5 meters in length;
- jet skis built before 2005;
- vessels built before 1997, if they have been offered on the market of the European Union before 1997;
- vessels built by a natural person for personal use and which will not be offered on the market of the European Union during the next five years after their registration. If a self-made vessel is not subject to a conformity assessment procedure and is not CE marked, the vessel` can only be registered in the ownership and possession of the natural person manufacturer, without the right to alienate it to another person on the EU market within the next five years. In the registration certificate of such a vessel, in the section “Remarks” will be indicated the entry “Prohibited to alienate until ...” with a term of 5 years from the date of the first registration;
- Vessel engines built before 2005.
Justification:
- Cabinet Regulation No. 647 of 30 August 2005 “Regulations on Construction, Conformity Assessment and Placing on the Market of Recreational Craft”.
- Directive 94/25 / EC of the European Parliament and of the Council of 16 June 1994 on the approximation of the laws, regulations and administrative provisions of the Member States relating to recreational craft.
- Directive 2003/44 / EC of the European Parliament and of the Council of 16 June 2003 amending Directive 94/25 / EC on the approximation of the laws, regulations and administrative provisions of the Member States relating to recreational craft.
- Directive 2013/53 / EU of the European Parliament and of the Council of 20 November 2013 on recreational craft and personal watercraft and repealing Directive 94/25 / EC.
The CE marking of a vessel (outboard engine) is attested by:
- the marking on the manufacturer's plate, which is determined by the CSDD employee when verifying data on the vessel or its engine units;
- a document issued by the manufacturer of the vessel or its official representative in Latvia (acceptance-transfer deed), which contains an indication regarding the existence of the CE marking;
- a document on conformity assessment of a vessel or its engine issued by an accredited small craft conformity assessment body notified to the European Commission or a conformity assessment body notified by other EU Member States or EEA countries. At present, there is no institution in Latvia that would be entitled to perform the conformity assessment procedure for vessels.
