Administrative penalties for road traffic violations are applied in accordance with the Administrative Liability Law and Chapter IX of the Road Traffic Law “Administrative Violations in Road Traffic and Competence in Administrative Violation Proceedings”.
The fine imposed on the fined person shall be paid in full not later than within one month from the day when the decision on the fine has entered into force.
In accordance with Section 43 of the Road Traffic Law, until the payment of the imposed fine to a person to whom the relevant administrative fine has been imposed, it is prohibited:
- receive a driving licence;
- to perform a state road worthiness test of a vehicle owned (possessed, held) by a person and registration activities in the state register of vehicles and their drivers or in the state information system of tractor equipment and its drivers, except for writing off the vehicle and suspending the registration of the vehicle by handing over number plates.
It is important that the institution whose official has imposed the fine immediately after the expiration of the term of voluntary execution of the fine transfers the decision regarding the enforcement of the fine to a sworn bailiff. The CSDD draws attention to the fact that, in cases where a judgment on the sentence has been handed down for enforcement by a sworn bailiff and the vehicle has been barred from carrying out certain activities in the CSDD (if registered), the payment of the fine does not mean the possibility of obtaining the service of the CSDD immediately thereafter, since the registered barring of the vehicle by a sworn bailiff can only be revoked by a sworn bailiff. Accordingly, after the payment of the fine, the person must apply to a sworn bailiff, requesting the removal of the registered ban on activities with a specific vehicle.
Fines for road traffic violations are included in the state basic budget revenue.
Fines for violations of the rules for stopping and parking a vehicle shall be included in the budget revenue of the relevant local government.
Information on the payment of fines can be seen in the CSDD database:
- immediately, if the fine has been paid at the CSDD cash desk;
- usually after 3 days, if the fine has been paid at the bank (because the information from the bank must reach the Treasury, from the information center of the Ministry of the Interior).
In cases where for some reason a person has paid a fine several times, the person must apply to the SRS (VID) regional office, taking with them documents confirming the payment of the fine. Given that fines for road traffic violations are included in the state basic budget revenue, the CSDD cannot refund the overpaid fine.
