Privacy Policy

The Privacy Policy stipulates the procedure for the processing of the data of natural persons and implementation of data subjects’ rights, and other matters related to the protection of personal data at the SJSC (VAS) “Ceļu satiksmes drošības direkcija” (Road Traffic Safety Directorate) (hereinafter referred to as – the CSDD).

The CSDD, as a controller, performs personal data processing in accordance with the General Data Protection Regulation No. 2016/679 (hereinafter referred to as – the Regulation), Personal Data Processing Law, Road Traffic Law and Maritime Code, as well as other laws and regulations applicable in Latvia.

Within the framework of the applicable regulatory enactments, the CSDD ensures the confidentiality of personal data and has implemented appropriate technical and organisational measures for the protection of personal data. A personal data protection specialist is involved in ensuring the compliance of the CSDD with personal data processing.

The purposes, technical basis and principles of personal data processing

The CSDD implements state delegated functions in the field of road safety, as well as providing a range of services and therefore processes a large amount of different personal data relating to vehicles or watercrafts owned by individuals and the licences to drive them, as well as various related restrictions.

For the provision of CSDD basic services (vehicle registration, technical inspection, issue of driving licences, issue of bicycle certificates, registration of watercrafts and their engines, etc.) and their quality control;

The CSDD processes personal data for the following basic reasons:

  • For the provision of CSDD basic services (vehicle registration, technical inspection, issuing of driving licences, issuing of bicycle certificates, registration of watercraft and their engines, etc.) and their quality control
  • For the provision of CSDD e-services and their quality control
  • For the collection of taxes and penalties within the competence of the CSDD
  • For the processing of payments
  • For personnel management
  • For providing education and information to the public, for development of training materials on traffic safety, for road traffic accident prevention
  • For the provision and maintenance of operations of the Riga Motor Museum (hereinafter referred to as – Motor Museum) and its Bauska Branch
  • For the provision of operations of the national Biķernieki complex’s sports facilities (hereinafter referred to as – BKSB)
  • For the maintenance of stationary technical systems for recording road traffic violations;
  • For the maintenance of the motorway toll payment portal;
  • For the maintenance of statistics on road traffic accidents and analysis thereof
  • For the provision of technical inspection of vehicles by the state, including monitoring of technical control and quality control, training of technical inspection inspectors and the attestation process
  • For assessment of the compliance of vehicles and components thereof with the technical norms
  • For inspection authorities, representatives of manufacturers, collaboration partner companies and their employees for ensuring the granting of special rights

The legal basis for personal data processing by the CSDD is fulfilling legal obligations, legitimate interest, the exercising of public law functions and, in separate cases – obtaining the consent of the data subject.

The CSDD protects personal data by using modern technology, taking into account existing privacy risks and the organisational, financial and technical resources that are reasonably available to the CSDD. As part of personal data processing, the CSDD implements risk management and information circulation security measures in accordance with the LVS/ISO/IEC 27001:2013 “Information technology standard. Security methods. Information security management systems. Requirements.”

Sources of personal data collection

In general, the CSDD acquires personal data from the data subject, when performing tasks specified in the regulatory enactments and when providing services (for example, when registering a vehicle, issuing a driving licence, granting roadworthy status to a historic vehicle, charging fees, etc.). In certain cases, according to the procedures specified in regulatory enactments, the CSDD also obtains personal data from other information systems and registers of the Republic of Latvia (for example, the Register of Natural Persons, the register of criminal records, etc.), foreign information systems, state and municipal institutions, medical institutions, educational institutions, etc.

Video surveillance and audio recording

The CSDD carries out video surveillance with or without audio recording capabilities in qualifying vehicles, CSDD buildings and territories, including at CSDD customer service centres, technical inspection facilities, on the premises of the Riga Motor Museum, at the BKSB, electrical charging stations, car parks, etc.

Video surveillance is primarily carried out with the purpose:

  • To defend the statutory interests of individual data subjects, preventing infringements of property rights and administrative procedural rights, possible fraud aimed against a person, etc., as well as identifying and preventing trespassing by unauthorised persons
  • To safeguard the public interest in the field of traffic safety by preventing the registration of non-roadworthy vehicles and thereby keeping such vehicles off the road
  • To supervise the activities of state officials and employees in the performance of their duties, ensuring they comply with the law, and implementing the tasks of public authority, which are entrusted to the CSDD
  • To safeguard the public interest in the field of traffic safety by keeping non-roadworthy vehicles off the roads
  • To protect the property of people and capital companies against unlawful third-party activities preventing property damage, thefts and other danger to property rights, as well as trespassing by unauthorised persons
  • To ensure public order in public places by preventing disturbances to public order and violations, without endangering the public
  • Surveillance cameras at the points of provision of information have been equipped with sound detectors to hear people’s exact conversations, their requests expressed and questions asked, the answers and explanations provided, to track the activities performed, and so forth.
  • Surveillance cameras at the points of payments have been equipped with sound detectors to hear people’s exact conversations, their requests expressed and questions asked, the answers and explanations provided, to track the activities performed, and so forth.
  • To safeguard the public interest in the field of road traffic safety by preventing the acquirement of a driving licence in an improper and unsafe manner, as well as preventing participation of unqualified drivers in road traffic
  • To ensure safe and proper electrical charging of vehicles

For the purposes of customer service quality improvements, audio recordings of consultative and helpdesk phone calls conversations are made.

Information about video surveillance and audio recordings is presented in the form of warning signs before the video surveillance area, while information on conducting audio recordings of the consultative and helpdesk phone calls is played back before the call is put through.

Duration of storage of personal data

The CSDD stores personal data in accordance with the defined personal data processing purposes and the legal basis for the processing of personal data, as long as at least one of the following criteria exists:

  • The CSDD has a legal obligation to store the data;
  • The CSDD has to implement its legitimate interests;
  • The CSDD has to implement its undertaken contractual obligations;
  • the consent of the data subject to the processing of relevant personal data is in force.

In accordance with the Regulation of the Cabinet of Ministers No. 185 of 30.04.2019 “Regulations of the State Register of Vehicles and Their Drivers”, when updating or correcting information in the register, the previous (historical) information shall be stored with the register.

Recipients of personal data

The CSDD shall not transfer information to third parties without lawful grounds.

Information about a vehicle belonging to a natural person in identifying personal data is restricted access information and can be obtained by the person himself/herself on the vehicles owned by him/her, by law enforcement authorities, by state and local government authorities, by other persons specified in the law, as well as by persons appointed by the Cabinet of Ministers and who require information for the performance of work or service functions.

In accordance with the regulatory enactments personal data is received from the CSDD by: The Information Centre of the Ministry of the Interior, State Police, State Border Guard, State Revenue Service, the Register of Enterprises of the Republic of Latvia, Central Statistical Bureau,
public prosecutor’s offices and court authorities, local governments and their institutions, insurance companies, Motor Insurers’ Bureau of Latvia, sworn bailiffs, sworn advocates, insolvency proceeding administrators, medical practitioners, CSDD employees, etc. The CSDD may exchange information with the registries of other European countries, if there is a legal basis for the exchange of personal data and if an appropriate request has been received. In accordance with international obligations and regulatory enactments the CSDD provides the exchange of information with the competent authorities of other countries.

The CSDD may use personal data processors for personal data processing. In such cases the CSDD shall take the necessary steps to ensure that such data processors process personal data in accordance with CSDD guidelines and in accordance with the applicable regulatory enactments, and shall require the implementation of appropriate security measures.

A data subject’s access to their personal data, and other rights

In order to receive information about personal data that the CSDD processes about a person, the person can use the e-services provided by CSDD on the website https://e.csdd.lv. Within the order as provided by the regulatory enactments, a person has the right to address the CSDD and to also obtain information using other means of obtaining information. A data subject can apply with a submission to the CSDD in Riga, at 6 S.Eizenšteina Street, LV-1079, or by using the e-mails: csdd@csdd.gov.lvdatu.specialists@csdd.gov.lv.

The data subject has the right to request the restriction of personal data processing, to object against personal data processing or to request correction of personal data in accordance with the provisions of the Regulation.

The CSDD communicates with the data subject, using the contact details provided by the data subject or by sending letters to the person’s declared place of residence.

In cases where personal data breaches are found or in cases of concern about a possible breach, everyone is encouraged to address any CSDD department or to contact the CSDD Data Protection Officer. Complaints regarding a personal data protection breach may also be submitted to the Personal Data Supervisory Authority in accordance with the procedures specified in the regulatory enactments.

Amendments to the Privacy Policy

The CSDD has the right to make changes to the Privacy Policy at any time, by publishing them on the website www.csdd.lv.
